Policy Summary
This policy provides for compensation to employees for work related injuries & diseases contracted in the course of employment. It is guided by the WIBA Act 2007.
Client Profile
All employers: the ACT applies to all employees, including employees employed by the government, other than the armed forces, in the same way and to the same extent as if the government were a private employer. However the following shall not be regarded as employees for purposes of this ACT.
- Any person employed outside Kenya for a continuous period of 12 months or more
- A member of the employer’s family dwelling in the employer’s house or cartilage thereof and not for purpose of employment
- A member of the armed forces as defined in the armed forces Act
Main Features
The structure of benefits is as follows:-
- A) Death: 96 months earnings subject to the maximum limit of liability of Kshs.4,000,000.00.
- B) Permanent Total Disablement: Percentages as set out in the First Schedule of Work Injury Benefits Act, 2007 subject to the maximum amounts set out under the limit of liability table above.
- C) Temporary Total/Partial disablement: As per the Work Injury Benefits Act, 2007 subject to a maximum of twelve months earnings.
- D) Medical Expenses: Actual expenses incurred but limited to Kshs.100,000.00 per employee
- E) Funeral Expenses: 30,000.00 per deceased employee
