Policy Summary
Liability Insurance under Aviation Insurance is provided in two parts:
1. Legal Liability to Third Parties other than passangers
The Insurer will indemnify the Insured for all sums which the Insured shall become legally liable to pay, and shall pay, as compensatory damages (including costs awarded against the Insured) in respect of accidental bodily injury (fatal or otherwise) and accidental damage to property caused by the Aircraft or by any person or object falling therefrom
EXCLUSIONS APPLICABLE TO THIS SECTION ONLY
The Insurer shall not be liable for claims arising from
- Injury (fatal or otherwise) or loss sustained by any director or employee of the Insured or partner in the Insured’s business whilst acting in the course of his employment with or duties for the Insured;
- Injury (fatal or otherwise) or loss sustained by any member of the flight, cabin or other crew member whilst engaged in the operation of the Aircraft or while such crew member is any way engaged in his capacity as such
- Injury (fatal or otherwise) or loss sustained by any passenger whilst entering, on board, or alighting from the Aircraft;
- Loss or damage to any property belonging to or in the care, custody or control of the Insured.
Further, this Policy does not apply to claims directly or indirectly occasioned by happening through or in consequence of:
- Noise (whether audible to the human ear or not), vibration, sonic boom, and any phenomena associated therewith;
- Pollution and contamination of any kind whatsoever;
- Electrical and electromagnetic interference;
- Interference with the use of property;
Unless caused by or resulting in a crash, fire, explosion or collision, or a recorded in flight emergency causing abnormal aircraft operation.
Limit of Indemnity
The liability of the insurance company under this Section shall not exceed the amount of indemnity agreed to between the insurance company and the aircraft owner and stated in the policy schedule. The insurance company will also defray, in addition, any legal costs and expenses incurred with consent in defending any action which may be brought against the insured person in respect of any claim for compensatory damages covered by this Section.
Legal Liability to Passangers
The insurance company will indemnify the Insured person in respect of all sums which the Insured person shall become legally liable to pay, and shall pay, as compensatory damages (including costs awarded against the Insured) in respect of:
- Accidental bodily injury (fatal or otherwise) to passengers whilst entering, on board, or alighting from the aircraft
- Loss of or damage to the baggage and personal articles of passengers arising out of an Accident to the Aircraft.
EXCLUSIONS APPLICABLE TO THIS SECTION ONLY
The Insurer shall not be liable for injury (fatal or otherwise) or loss:
- Sustained by any
- members of the household or family of the Insured,
- director, employee or partner of the Insured or member in the Insured’s business whilst acting in the course of their employment with or duties for the Insured,
- member of the flight, cabin or other crew member whilst engaged in the operation of the Aircraft, or while such crew member is in any way engaged in his capacity as such.
- Whilst the total number of passengers being carried in the Aircraft exceeds the declared maximum number of passenger seats stated in the Schedule hereto.
Limit of Indemnity
The liability of the insurance company under this Section shall not exceed the amount agreed to between the insurance company and the insured person and stated in the policy schedule hereto. The insurance company will defray, in addition, any legal cost and expenses incurred with its written consent in defending any action which may be brought against the insured person in respect of any claim for compensatory damages covered by this section.
